Converting an FY 2006 Case to FY 2005 Case Under the Increased Cap

Any petitioner that has already filed an H-1B petition for a FY 2006 start date may upgrade the filing to a FY 2005 start date if its for an advanced degree holder from a US university. This can be done using the regular or premium processes. If FY 2005 numbers are all used, the case will be reapplied to the FY 2006 cap.
