US CIS May Accept H-1B Applications from Advanced US Degree Holders

To date, no rule has been issued regarding filing of H-1B petitions under the fiscal year 2005 increased cap of 20,000. However, we have received word that US CIS MAY be accepting cases under this cap, from those who hold advanced degrees from US universities. Therefore, our firm will be filing all cases (including from those who do not have advanced degrees from US universities) that were to be applied to the increased cap, immediately. We will be duly noting them with immediate start dates if available, and alternatively, start dates for October 1, 2005.

We have no idea whether these cases will be accepted. However, and without guidance, we have no choice but to attempt this at this point.
