Proposed Rule on Labor Certification Substitution Published Today

The DOL rule eliminating the availability of labor certification substitutions, and imposing a 45-day deadline for employers to file approved labor certifications with U.S. Citizenship and Immigration Services was proposed today. The rule titled "Labor Certification for Permanent Employment of Aliens in the United States; Reducing the Incentives and Opportunities for Fraud and Abuse and Enhancing Program Integrity" will now be in a public comment period before being implemented.
