Partial Elimination of Labor Certification Substitutions

DOL re-submitted the proposed rule that would eliminate Labor Certificatation substitutions and which adds enforcement measures. This proposed rule also would impose 45 days to file the I-140 after Labor Certification. The rule was submitted to the OMB on 2/2/06 and was cleared by them the same day. It appears that this Rule is likely to be published soon. AILA will monitor the situation, and intends to submit comments.
